Clarus is an experimental AI grading tool. It can and will make mistakes, hallucinate facts, or provide inaccurate medical rationale. You are solely responsible for verifying all medical information generated by the AI against official Kasr Al Ainy curriculum guidelines and clinical textbooks.

3. User Eligibility & Account Registration

You must provide accurate, current, and complete information during the registration process. You are solely responsible for maintaining the confidentiality of your account password. ResusClear reserves the absolute right to reject any registration at our sole discretion.

When you purchase or enroll in a course on ResusClear, you are not buying the course. ResusClear and its hosted teachers reserve the absolute right to modify, update, remove, or completely revoke access to any course, video, or document at any time, without prior notice and without liability.

5. "Lifetime Access" Definition

If a course is advertised as "lifetime access," this refers to the lifetime of the course's availability on our servers, not your literal human lifespan. If we sunset a feature, upgrade the Engine, or take down a module, your access to that specific iteration ends instantly.

6. Account Sharing & Piracy

Your account is for your personal use only. Sharing credentials with study groups, friends, or third parties will result in an immediate, permanent ban without a refund. You may not screen-record, screenshot, scrape, download, or distribute any content from this platform. Any unauthorized distribution (e.g., uploading our PDFs to Telegram) will trigger immediate legal retaliation and civil damages.

7. Zero-Tolerance for Hacking & Privilege Escalation

Any attempt to exploit, hack, reverse-engineer, spoof, or execute SQL injections against the ResusClear database is strictly prohibited. If a user or a hosted Teacher attempts to manipulate the system to gain unauthorized administrative access, view hidden user data, or alter backend parameters, we will immediately terminate the account and pursue maximum civil damages and criminal prosecution under applicable cybercrime laws.

يُحظر تماماً أي محاولة لاستغلال أو اختراق أو هندسة عكسية أو انتحال شخصية أو تنفيذ عمليات حقن SQL ضد قاعدة بيانات ريساس كلير. إذا حاول مستخدم أو معلم مستضاف التلاعب بالنظام للحصول على وصول إداري غير مصرح به، أو عرض بيانات مستخدم مخفية، أو تغيير معلمات الواجهة الخلفية، فسنقوم على الفور بإنهاء الحساب ومتابعة أقصى درجات التعويضات المدنية والملاحقة الجنائية بموجب قوانين الجرائم الإلكترونية المعمول بها.

8. Server Telemetry, Anti-Scraping & Automated Bots

The use of bots, scrapers, web crawlers, automated scripts, or browser extensions to extract data, questions, or medical notes from ResusClear is illegal. If our telemetry detects an unnatural volume of requests (e.g., attempting to scrape the Q-Bank), your IP address and account will be permanently blacklisted without warning.

You guarantee that your uploads do not violate copyright laws or contain confidential patient data (HIPAA violations).

Medical education can be raw. You acknowledge that you may encounter user-generated content, teacher audio, or Clarus AI outputs that you find unprofessional, offensive, or inappropriate. ResusClear disclaims all liability for the spontaneous generation of offensive language by the AI or the personal conduct of independent teachers on the platform.

ResusClear is not liable for academic mistakes, outdated medical protocols, or false marketing claims made by third-party teachers using our infrastructure.

16. Payments and No-Refund Policy

We aim for 100% uptime, but servers crash. We do not guarantee that the Resus Engine or the Clarus AI will be uninterrupted or bug-free. We are not liable for any failure to deliver our services due to causes beyond our control (internet outages, natural disasters, governmental actions). If the site goes down the night before your final exam, we are not legally liable.

We welcome constructive feedback inside our private support channels. However, if a user intentionally spreads false, malicious, or unverified claims about ResusClear, its software integrity, or its hosted teachers on public social media, ResusClear reserves the right to immediately terminate the user's license and pursue legal action for civil defamation and tortious interference under Egyptian law.

You have the right to terminate your account at any time. We reserve the absolute right to suspend or terminate any account, at any time, for any reason, without prior notice, if we determine that you have violated these terms or pose a threat to the platform's integrity.

25. Severability

If any individual provision, clause, or sentence of these Terms and Conditions is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that specific provision shall be severed. The remaining provisions will remain 100% valid, binding, and fully enforceable.

No failure or delay by ResusClear in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right, nor shall any single or partial exercise of any right preclude any other or further exercise of it.

27. Governing Law & Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Arab Republic of Egypt. Any legal disputes, claims, or lawsuits arising from the use of ResusClear will be subject to the exclusive jurisdiction of the courts located in Cairo, Egypt.

تخضع هذه الشروط والأحكام وتفسر وفقاً لقوانين جمهورية مصر العربية. تخضع أي نزاعات أو مطالبات أو دعاوى قضائية تنشأ عن استخدام ريساس كلير للاختصاص القضائي الحصري للمحاكم الواقعة في القاهرة، مصر.

28. Entire Agreement

These Terms and Conditions, along with our Privacy Policy, constitute the entire and sole legal agreement between you and ResusClear regarding your use of the platform. They completely supersede and replace any prior verbal agreements, messaging app promises, social media claims, marketing ads, or written representations made by any co-founder, representative, or teacher.

29. Independent Contractor Status (No Employment)

Teachers utilizing ResusClear operate strictly as independent third-party entities. This agreement does not create a partnership, joint venture, agency, or employer-employee relationship. You are solely responsible for your own taxes, medical licensing, and legal compliance. ResusClear provides the software infrastructure; we do not employ you.

يعمل المعلمون الذين يستخدمون منصة ريساس كلير بشكل صارم ككيانات خارجية مستقلة. لا تنشئ هذه الاتفاقية شراكة أو مشروعاً مشتركاً أو وكالة أو علاقة صاحب عمل بموظف. أنت وحدك المسؤول عن ضرائبك وتراخيصك الطبية وامتثالك القانوني. توفر ريساس كلير البنية التحتية البرمجية؛ نحن لا نوظفك.

30. Decentralized Student Payments & Zero Financial Liability

ResusClear does not process, hold, or touch student payments for course access. All financial transactions happen entirely off-platform via third-party manual methods (e.g., Instapay, Vodafone Cash) established solely by the Teacher. The platform only provides a digital ledger to upload receipts and grant access. ResusClear takes absolutely zero liability for fraudulent receipts, failed transfers, bounced payments, or students who scam the Teacher. If you grant access to a student who didn't actually pay you, that is your absolute financial loss, not ours.

لا تقوم ريساس كلير بمعالجة أو الاحتفاظ أو التدخل في مدفوعات الطلاب للوصول إلى الدورات. تتم جميع المعاملات المالية بالكامل خارج المنصة عبر طرق يدوية تابعة لجهات خارجية (مثل إنستاباي، فودافون كاش) يحددها المعلم حصرياً. توفر المنصة فقط دفتراً رقمياً لرفع الإيصالات ومنح الوصول. لا تتحمل ريساس كلير أي مسؤولية مطلقاً عن الإيصالات الاحتيالية، أو التحويلات الفاشلة، أو المدفوعات المرتجعة، أو الطلاب الذين يحتالون على المعلم. إذا منحت وصولاً لطالب لم يدفع لك فعلياً، فهذه خسارتك المالية المطلقة وليست خسارتنا.

31. Instructor Billing, Monthly Dues & Debt Collection

31. فواتير المعلمين والمستحقات الشهرية وتحصيل الديون

ResusClear collects its platform infrastructure fees and AI token usage fees directly from Teachers on a monthly basis, billed off-platform according to our generated server usage logs. If a Teacher fails to pay their monthly invoice, refuses to pay, or disputes the valid server charges, ResusClear reserves the absolute right to instantly suspend, lock, or permanently delete the Teacher's entire account, courses, and student rosters. Furthermore, ResusClear retains the right to pursue full legal action and debt collection in Egyptian courts for any unpaid platform fees.

تُحصّل ريساس كلير رسوم البنية التحتية للمنصة ورسوم استخدام رموز الذكاء الاصطناعي مباشرة من المعلمين على أساس شهري، ويتم إصدار الفواتير خارج المنصة وفقاً لسجلات استخدام الخوادم التي ننشئها. إذا فشل المعلم في دفع فاتورته الشهرية، أو رفض الدفع، أو اعترض على رسوم الخادم الصحيحة، تحتفظ ريساس كلير بالحق المطلق في التعليق الفوري أو القفل أو الحذف الدائم لحساب المعلم بالكامل ودوراته وسجلات طلابه. علاوة على ذلك، تحتفظ ريساس كلير بالحق في اتخاذ إجراءات قانونية كاملة وتحصيل الديون في المحاكم المصرية مقابل أي رسوم منصة غير مدفوعة.

32. The "Inside Job" (Assistant & Staff Liability)

Teachers have the ability to invite Assistants and staff to manage their clinics. You, the Teacher, are 100% legally and financially responsible for everything your invited staff members do. If your Assistant steals your proprietary lectures, deletes your student roster, fills up your allocated storage quota, or grants unauthorized access to students, ResusClear is completely immune from liability. You explicitly agree to fully indemnify and protect ResusClear from any lawsuits filed by students regarding your specific curriculum.

You retain ownership of your intellectual property, but you grant us the absolute right to use it to make our software smarter. You are not entitled to any financial compensation, royalties, or revenue share for the platform's utilization of your data.

You are strongly advised to keep local backups of all your course materials. You explicitly waive the right to sue ResusClear for technical glitches, data loss, or AI grading errors.

ResusClear will not issue refunds or compensate students under any circumstances.

If we determine that you are abusing the system, misusing the Clarus AI, mistreating students, or posing a legal liability to the platform, your access will be instantly revoked. You waive any right to sue for "lost profits" or "business interruption" resulting from your removal from the platform.
